Fans of 90 Day Fiancé have concerns regarding Biniyam Shibre‘s first child and the custody dispute, particularly now that he is in the US. The 90 Day Fiancé: The Other Way season 2 cast has been expanded to include Biniyam and his partner, Ariela Weinberg.
They are also a popular couple in the ninth season of 90 Day Fiancé. In December 2019, Ariela relocated to Ethiopia to give birth to the couple’s first child, Aviel. Biniyam has an older son with the American woman he was married to before Ariela and Avi.

Simon, Biniyam’s first son with his former wife, Bria, was born in the United States in 2017. Due to a rare congenital condition, Simon’s intestines developed outside of his body. Due to this, Bria was unable to travel back to Ethiopia to give birth. Although 90DF star Biniyam received Humanitarian Parole for the birth, he has not spoken to his son since divorcing Bria. Biniyam’s lack of contact with his 5-year-old son has affected him, and on occasion, he writes poignant notes to Simon on his Instagram handle. As he writes hopeful letters requesting assistance and prayers, this has touched the hearts of many followers.
He eventually had the opportunity to act in September 2021 after traveling to America on a K-1 visa and, presumably, getting married to Ariela. He submitted a petition to change Simon’s custody and set up parenting time. Following that, on October 6, 2021, Bria requested an injunction, which was granted that same day. Biniyam’s appeal indicates that he has visiting rights, even though it acknowledges that Bria was given guardianship and custodianship at the time of the divorce in Ethiopia.
According to Monsters & Critics, Biniyam is requesting joint legal custody with a reasonable visitation schedule. His move to the United States constitutes a major change in circumstances, and he bases his motion on the fact that he is still being denied parenting time.
Although Biniyam and Bria submitted a Mediation Certificate of Attendance in November 2021, the Writ of Injunction specifies what Biniyam may not do with respect to Simon until the trial on October 26 and 27 of this year. The Writ of Injunction also places various restrictions on Biniyam, banning him from allowing a third party to pick up the child or revealing details of his son Simon’s development online.
Even though the contract specifically prohibits addressing Simon on 90 Day Fiancé, Biniyam continues to talk about applying for custody, and viewers are eager to see how the court case plays out on the show. According to an Affidavit of Financial Status submitted to the Iowa court, Biniyam had less than $500 as of February 2022 and earned nothing all month. It’s also possible that he is still trying to make a living as an MMA fighter and has not yet reached the point in his career where doing so is lucrative.
There is a rumor that Ariela’s parents may be contributing to the court expenses. After witnessing Biniyam with his kid Avi, many 90 Day Fiancé viewers are applauding his efforts to forge a closer relationship with Simon. Bria’s life has undoubtedly been affected by his transfer to America, but Biniyam deserves the opportunity to co-parent with his kid.
He doesn’t want sole physical custody; rather, he merely wants reasonable parenting time, along with joint legal custody to share in decision-making. In the end, their kid will gain if Biniyam and Bria can effectively co-parent. Let’s hope they can get back together.
