    What Happened After Josh Duggar’s Team Filed Appeal, With Court Documents Revealing Shocking Details?

    There is new information coming out Counting On star, after Josh Duggar’s legal team filed an appeal earlier this week requesting a new trial for the reality show star’s federal conviction on child pornography charges. Viewers know that Josh was sentenced to 12.5 years in prison. Now, his team argues that he was“unfairly” restrained by Homeland Security and that he was not allowed his right to his attorney. 

    Why Is Josh Duggar’s Team Filing An Appeal?

     The New York Post have obtained some court documents that revealed that Homeland Security had eyes on the reality show star’s car lot for sometime before they executed the search warrant. The obtained court documents describe the car lot as “in the middle of nowhere,” as per the outlet. As stated in the documents, Homeland Security waited for the Counting On star to return to the car lot in November of 2019 before they sprung into action.

    Josh’s legal team are arguing that he did not need to be at the car lot, and there was “no reason” for his presence on the property while they searched. After the reality show star arrived the car lot, he was reportedly “surrounded by armed agents wearing ballistic vests, and without access to a vehicle. [He] attempted to call his attorney only to have his phone physically taken and was told his attorney would not be allowed on the scene.”

    Josh Duggar’s legal team continued to say that he was forced to wait in a police car with two armed agents after they took his phone from him and he was denied his right to an attorney.

    “This court should conclude a reasonable person in Duggar’s position would have felt ‘deprived of his freedom of action in any significant way.’ The government also contends Duggar was not restrained. But restraint is about more than being handcuffed.”

    The Counting On star’s legal team also says the government argues that he wasn’t restrained since he was not handcuffed. They continue to point out that there is no difference between his phone being seized while he is being forced into the back of a police car and being handcuffed. Since he was not with a vehicle, authorities argue Josh Duggar was not restrained, so he was unable to leave. However, his legal team argues he would have left on foot.
