Shocking news has just broken. Joe Mercury has attacked Ring of Honor and Sinclair Broadcasting after filing an official lawsuit on the grounds that his contractual entitlements were not met.
Joe Mercury Files Lawsuit For Unpaid Wages
Thanks to Bodyslam, who broke the news of the lawsuit, we can see the exact details. So what were the grievances? Well, it seemed that Joe was not getting paid exactly what he should have been entitled to. Whether this was a genuine mistake or deliberate to cut corners during the pandemic is anyone’s guess.
But the lawsuit stated: “He was paid substantially less than other individuals performing these same services for similar companies. As such, Joe was classed as an independent contractor and not an employee, which meant a smaller pay packet despite doing the same amount of work.”
And yet, it was not just pay that was getting in the way. There were concerns that Joe was being risked due to the absence of proper health and safety. Given that covid has plagued the world, this should have been a priority. The lawsuit, however, stated otherwise: “Birch expressed concerns to ROH and Sinclair regarding the lack of safety protocols and available medical supervision during the matches.
This left Joe in a complete state of disorder. Knowing that he was being paid less forced him to pursue only one option: quit. But this was not a free choice, as the lawsuit revealed: “As a direct and proximate result of Birch’s complaints and actions regarding the lack of safety protocols at Sinclair and ROH wrestling events and Sinclair and ROH’s complete lack of concern for the safety of the wrestlers, Birch was forced to resign.”
And Joe is clearly seeking to be compensated not only for his loss of earnings at the time but also due to the earnings he has not been able to accrue because of the forced resignation: “Birch is entitled to compensatory damages directly resulting from the termination of the relationship with Sinclair and ROH.”
We will have to see whether Joe has a case, but if what is outlined in the lawsuit did happen, then it does not look perfect for the other side.
