On Tuesday, 10th January 2022, Harvey Weinstein’s defence attorneys put in an appeal asking for a retrial for his New York conviction of rape in 2020.
The Disgraced Harvey Weinstein’s Legal Team Appeals His Rape Conviction
Weinstein’s advocate, Arthur Aidala, claimed that Weinstein was not given a fair trial and was deprived of an impartial jury. In 2020, a jury found Weinstein guilty of forcefully performing oral sex on Mimi Haley, a production assistant, in 2006, as well as raping an up-and-coming actress in 2013.
This resulted in a 23-year prison sentence. However, he was acquitted of rape and sexual assault claims made by Annabella Sciorra during the ’90s. He has consistently denied engaging in any sexual activities that lacked consent.
With that being said, his lawyer Aidala had this to say: “The trial court repeatedly abandoned its duty to safeguard Weinstein’s constitutional guarantees and procedural rights, leaving him powerless to defend against an unchecked prosecutor whose strategy was to swamp the jury with prejudicial bad character evidence to distract from the fallibilities in the complainants.”
After he was declared guilty in New York, Weinstein was sent to California in 2021 to stand trial for sexual misconduct claims implicated by four women in Los Angeles and Beverly Hills that occurred between 2004 and 2013.
And with so much controversy surrounding the movie producer, the fans on social media had a lot to say. A significant proportion of people voiced their disapproval against an appeal since it was seen as a way for Weinstein to try and avoid accountability for his actions.
One person wrote: “Request denied. Now go back to prison. You’ll never touch another woman. Not ever. You abused your position of power.”
While another person stated: “I want him held accountable or I want your most profitable subordinate from the Jeffrey Epstein list put in jail and his career taken away.”
