On Monday, the state rested its case against Josh Duggar in the child pornography trial. During their case, seedy details about what exactly was on the Duggar’s hard was shared with the jury. This included videos and images of sexual abuse involving underage girls.
The Defense for Josh Duggar Presents Its Case
Now, the defense takes the stage and it’s an uphill battle. A federal forensic team investigated the hard drives, they showed the jury evidence—which they state was found on said computer. It’s not a federal case where a simple defense will work.
Josh Duggar Defense Computer Analyst Says Child Porn Could’ve Been Downloaded Remotely
The defense’s case is that someone else put the images and video on Duggar’s computer. It’s not the most elaborate defense but there seems to be an in for them. A computer analyst stated that it was very possible to access Duggar’s computer remotely and either download or upload the images to it.
When your client is facing up to 40 years behind bars and hundreds of thousands in fines, you have to throw a Hail Mary and hope the jury catches it. This is the defense’s biggest gamble in the case.
It should be noted that it’s not up to the defense to explain who would do it and why nor does the jury have to solve it. The defense just has to present it and explain why it is very possible—although having a name and a reason would add more mustard to its case.
The counter to this is that the federal investigative unit has time logs showing exactly what was being done on Duggar’s computer at the time that the child porn was downloaded. Josh Duggar or—as the defense presents—another party also sent personal messages at the same time in May 2019.
In May 2015, the dominoes began to fall when TLC axed 19 Kids and Counting after it was revealed that Josh Duggar molested four sisters and a babysitter came out. The incidents happened between 2002 and 2003 and the family head and 19 Kids and Counting star Jim Bob Duggar told the Arkansas State Police what happened.
Also in 2003, Josh Duggar would later be taken to a family friend and state trooper who heard the details didn’t report them per state law, and would later be imprisoned on his own child porn charges for 56 years. The elder Duggar would inform the police that Josh had been entered into counseling for his problems.
All of this could very well impact the elder Duggar’s–a former state Representative–bid for an Arkansas Senate seat on December 14. More on this as the trial unfolds.
