A woman from Hialeah, Florida is suing Kraft Heinz Foods for $5 million because the label for Velveeta microwaveable macaroni and cheese says it only takes three and a a half minutes to cook. However, Amanda Ramirez said that isn’t the case.
Yes, this is an actual class action lawsuit that was submitted.
Florida Woman Sues Kraft Heinz Foods for ‘False and Misleading’ Velveeta Microwaveable Mac and Cheese Label
The class action lawsuit states, filed November 18, 2022, mainly hinges on it taking longer to prepare than the time on the label. According to Ramirez’s legal team, the three and a half minutes doesn’t factor in the other steps prior to putting the cup in the microwave and stirring it once it’s done.
Those other steps includes removing the lid and sauce, adding water to the pasta, then microwaving it, then stirring it. Ramirez’s lawyers say that customers are actually losing money because of the extra time—less than a minute if not less than 30 seconds—to do the steps before putting the meal in the mic.
On top of the $5 million, Ramirez is looking for punitive damages and for the Kraft Heinz to “be ordered to cease its deceptive advertising” as well as “be made to engage in a corrective advertising campaign.” Kraft Heinz Foods responded to CNN on the lawsuit saying:
“We are aware of this frivolous lawsuit and will strongly defend against the allegations in the complaint.”
