Harvey Weinstein was caught with Milk Duds in November. In documents obtained by Variety, the former film producer was found with the candied contraband on November 10 during a search.
That day, Weinstein met with his lawyer Shawn Burkley and guards told him that Burkley’s person and belongs would have to be searched in the future. However, Weinstein claimed that the Milk Duds were brought with him back in July when he was transported from the Wende Correctional Facility in New York.

According to officials, Weinstein was searched when he arrived at the L.A County Jail and they found nothing on him. This resulted in them believing that Burkley smuggled them in during the visit.
In a statement to Variety, Harvey Weinstein apologized for the embarrassing situation:
“This was an innocent misunderstanding. It will not happen again. I have been a model inmate, following the rules and regulations and I am sincerely sorry.”
Lead attorneys for Weinstein—Mark Werksman and Alan Jackson—issued an apology on behalf of their client where they stated that the incident “had not happened before, and never happened since.” Weinstein was also referred to as a “model inmate” in the apology.
Currently, he faces 11 charges of rape and sexual assault after being convicted in 2020. The 23-year sentence is being appealed with a ruling expected in the coming months.
As for his attorney visits, the jail opted not to revoke them. However, he was warned that if more contraband is discovered, the face-to-face visits would be revoked and his lawyers would have to a booth to talk with their client.
